By downloading, installing, or using Plein Air Pal, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app. We reserve the right to update these terms at any time, and your continued use of the app constitutes acceptance of any changes.
Plein Air Pal is a mobile application for the plein air painting community. The app enables users to discover painting locations, share their artwork on a map, follow other artists, and find and create local events including workshops and meetups.
To access most features of Plein Air Pal, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to create an account. You agree to provide accurate and current information and to update it as needed.
Plein Air Pal offers a premium subscription with the following plans: • Monthly Plan: $3.99 per month • Annual Plan: $24.99 per year Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You may cancel your subscription at any time through your device's app store account settings. Refunds are subject to the refund policy of the applicable app store (Apple App Store or Google Play Store). We do not offer refunds for partial subscription periods.
Subscribers may pay a one-time listing fee to publish workshop or meetup events on Plein Air Pal: • Workshop listing fee: $19.99 • Meetup listing fee: $9.99 Listing fees are non-refundable once a listing has been published. Event creators are solely responsible for the accuracy of their listing content, including dates, times, pricing, location, registration links, and event conduct. Plein Air Pal is not a party to any transaction between event creators and attendees and is not liable for any disputes, injuries, losses, or damages arising from user-created events.
You retain full ownership of all artwork and content you upload to Plein Air Pal. By uploading content, you grant Plein Air Pal a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your content within the app and for promotional purposes related to the app. You represent that you own or have the necessary rights to all content you upload, and that your content does not infringe the rights of any third party.
You agree not to use Plein Air Pal to: • Upload content that is not original plein air artwork • Harass, threaten, or abuse other users • Post spam, advertisements, or unrelated commercial content • Impersonate any person or entity • Violate any applicable law or regulation • Attempt to gain unauthorized access to any part of the service • Interfere with or disrupt the app or its servers • Upload malicious code or content
All rights, title, and interest in and to Plein Air Pal, including the app design, branding, features, and underlying technology, are owned by Plein Air Pal and its licensors. Nothing in these terms grants you any right to use Plein Air Pal's trademarks, logos, or branding without our prior written consent.
Plein Air Pal is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses. We are not responsible for the accuracy of any user-generated content, including event listings, painting locations, or profiles.
To the fullest extent permitted by law, Plein Air Pal and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of profits, personal injury, or property damage. Our total liability to you for any claim arising from use of the app shall not exceed the amount you paid us in the twelve months preceding the claim.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties. You may delete your account at any time through the app settings.
These Terms of Use are governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
